Legal Issues Surrounding CBD Use

The legal status of CBD in the US is tricky. This is because several states in the US have inaugurated their recreational and medical cannabis laws, which are different from the federal government laws.

According to the federal Controlled Substances Act of 1970, hemp is considered illegal. The legislation places all cannabis, including hemp, under the schedule 1 umbrella. However, the 2018 farm Bill legalized hemp cultivation and established a legal distinction between hemp and marijuana.

The new legislation categorizes hemp as any cannabis that contains less than 0.3%  THC. Marijuana is still classified as a schedule 1 substance, and CBD derived from the marijuana plant is still considered federally illegal.

 The FDA has continued to maintain its strict stance on selling or marketing CBD products as dietary supplements. Nonetheless, several states have sought to regulate the general use of CBD and CBD products irrespective of the FDA restrictions.

California’s CBD Law

The governor of California has recently signed the California Assembly Bill 45 Into law. This bill allows hemp-derived CBD to be included in any foods and dietary supplements sold in California. This move is a departure from the state’s prohibition of CBD to be included in such products and the FDA’s current stance on the issue.

However, the law still reserves the food and Drug Administration( FDA) to regulate processed hemp products. Here is a detailed look at the California Assembly Bill 45 on CBD-infused products.

  • The law asserts that food beverages and dietary supplements sold in California are not adulterated by including hemp-derived CBD and so are not in infringement with the FD & C Act, the Sherman Food, Drug, and Cosmetic Law.
  • The Department of Cannabis control is required to prepare a report for the governor and the legislature drafting the steps needed to incorporate hemp products into the cannabis supply chain.
  • The law compels the Department of Food And Agriculture and the State Department of Public health, in consultation with the Department of Cannabis Control to establish a process to share license, registration, cultivar, and enforcement information to enable compliance and enforcement against unlicensed manufacturers or the sale of hemp that does not meet specified requirements.
  • The law restricts the manufacture or sale of hemp products containing more than 0.3 Percent THC, including Delta 8 and 10 THC.
  • Prohibits manufacturers, distributors, or sellers from including on the label, publishing, or communicating in advertising or marketing a health-related statement on consuming products containing industrial hemp or cannabinoids.

CBD Testing and Labelling Regulations In California

Hemp growers would need to submit samples for third-party THC concentration testing not more than 30 days before harvest. Any industrial hemp plant that falls short of the testing standards will be destroyed.

Similarly, the California Department of Public Health is very clear on the regulations surrounding CBD products’ labeling. Information such as the ingredients, product’s origin, expiration, and amount of THC and CBD must be included in the labeling.
